State Fireworks Laws

In the continental United States, each state has their own laws regarding to the use of fireworks and sparklers. Sparklers, which are classified as a novelty item, are normally allowed in the majority states. However, there are a few states that prohibit their use, have restrictions on the time of year you can use sparklers, or may only allow sparklers in certain places.

Note that while we always try to keep this information current with the latest fireworks laws for a given state, we cannot guarantee the accuracy of this information. This information is for reference purposes only, and you should check with your state or local government before using sparklers at your event. Alabama

Permitted: Items that comply with regulations of the CPSC, DOT definitions, and trick noisemakers.

Prohibited: Manufacture, possession, sale or use of ground salutes containing more than 2 grains of explosive composition.

Selling Period: June 20-July 10 and December 15-January 1. Sales from tents or motor vehicles are prohibited.

Age of Purchase: 16 years, unless accompanied by adult.

 

Arizona

Permitted: None

Prohibited: Skyrockets, firecrackers, torpedoes, roman candles, and daygo bombs.

Selling Period: N/A

Arkansas

Permitted: Roman candles, skyrockets, helicopter rockets, cylindrical and cone fountains, wheels, torches, colored fire, dipped sticks, mines and shells, firecrackers with soft casings, and novelties (size limitations specified.)

Prohibited: N/A

Selling Period: June 20-July 10 and December 10-January 5 (Snakes and sparklers sales permitted all year.)

Age of Purchase: 12 years, unless accompanied by adult.

 

California

Permitted: Consumer Fireworks not prohibited (size limitations specified.)

Prohibited: Firecrackers, skyrockets, rockets, roman candles, chasers, surprise items, friction items, torpedoes, items resembling food, fireworks containing arsenic, phosphorus, thiocyanates magnesium (magnesium alloys permitted), mercury salts, picrates or picric acid, gallates or gallic acid, chlorates, (except those of alkali or earth metals), boron, titanium (except larger than 100 mesh), zirconium, gunpowder, and fireworks kits.

Selling Period: Noon, June 28, through noon, July 6.

Age of Purchase: 16 years old.

 

Colorado

Permitted: Cylindrical and cone fountain, ground spinner, torch and colored fire, dipped sticks and sparklers, snake and glow worm, trick noisemaker and certain other novelties.

Prohibited: All fireworks not listed as permitted.

Selling Period: N/A

Age of Purchase: 16 years of age.

 

Connecticut

Permitted: Hand-held and ground based sparkling devices that are non-explosive and non-aerial, and do not contain more than 100 grams of pyrotechnic composition per item.

Prohibited: All other consumer fireworks including multiple-tube sparkling devices that exceed 100 grams of total pyrotechnic composition.

Delaware

Permitted: No consumer fireworks are permitted in Delaware

Prohibited: All consumer fireworks are prohibited in Delaware

Florida

Permitted: Devices approved and listed by State Fire Marshal which emit a shower of sparks upon burning, do not contain any explosive compounds, do not detonate or explode, are hand held or ground based, cannot propel themselves through the air, and that contain not more than 100 grams of the chemical compound that produces sparks upon burning. Any device that is not included in the list of approved items is prohibited, except that snakes, small smoke devices, trick noisemakers and certain other novelties may be sold at all other times.

Prohibited: Firecrackers, torpedoes, skyrockets, roman candles, daygo bombs, and any fireworks containing explosive or flammable compounds.

Georgia  

Permitted: Sparklers up to 100 grams each; fountains (items that say ‘Emits Showers of Sparks’ up to 200 grams total for multiple tube items or 75 grams for each individual tube; snakes, glow worms, snappers, party poppers.

Prohibited: Firecrackers, torpedoes, sky rockets, roman candles, and bombs.

Idaho

Permitted: Non-aerial fireworks devices, such as ground spinners, fountains, sparklers, smoke devices, or snakes.

Prohibited: Any fireworks not specifically permitted, such as firecrackers, jumping jacks, or similar products.

Selling Period: Midnight, June 23 through midnight, July 5 and Midnight December 26 through midnight January 1. May be regulated by local jurisdictions as to dates allowed.

Illinois

Permitted: Sparklers, snake/glow worm pellets, smoke devices, trick noisemakers, and plastic or paper caps.

Prohibited: Firecrackers, torpedoes, skyrockets, roman candles, and bombs.

Selling Period: N/A

Age of Purchase: 18 years of age.

  

Indiana

Permitted: Consumer fireworks that comply with the construction, chemical composition, and labeling regulations of the U.S. Consumer Products Commission.  Fireworks may be used only on the user’s property or on the property of someone who has consented the use of fireworks on their property.  Consumer fireworks may be used only between 9am and 11pm on days other than holidays.  Holidays include Memorial Day, July 4, Labor Day and New Year’s Eve.

Prohibited: All fireworks not specifically permitted.

Iowa

Permitted: Snakes and Sparklers.

Prohibited: Firecrackers, torpedoes, skyrockets, roman candles, daygo bombs.

Kansas

Permitted: All pyrotechnic devices classified as consumer fireworks by DOT, except certain rockets.

Prohibited: Any rockets mounted on a wire or stick, any device containing such rockets.

Selling Period: June 27-July 5.

Age of Purchase: 18 years of age.

 

Kentucky

Permitted: Sky and Bottle Rockets, aerial spinners, Roman Candles, firecrackers, chasers, and mines, shell, aerial kits, reloadable tubes  not exceeding 200 grams.

Prohibited: Mines, shells, aerial kits, reloadable tubes exceeding 200 grams.

Selling Period: Sale of fireworks must be approved by CPSC.

Age of Purchase: 16 years of age.

 

Louisiana

Permitted: Consumer fireworks as defined by DOT and the CPSC. Cylindrical fountains, cone fountains, illuminating torches, pyrotechnic wheel devices, ground spinners, flitter sparklers, toy smoke devices, sky rockets and bottle rockets, missile-type rockets, helicopter aerial spinners, roman candles, mines or shells, firecrackers, and multiple tube fireworks.

Prohibited: Cherry bombs, tubular salutes, 2” American made salutes, firecrackers exceeding 1½”in length or ¼” in diameter, repeating bombs, aerial bombs, torpedoes exceeding ?” in diameter, roman candles larger than 10 ball, and sky rockets larger than 6 ounces.

Selling Period: Noon June 25 through midnight July 5, and noon December 15 through midnight January 1.

Age of Purchase: 15 years of age.

 

Maine

Permitted: Most ground-based consumer fireworks.

Prohibited: Missile-type rockets as defined by the State Fire Marshal, Helicopters and aerial spinners, Sky rockets and bottle rockets.

Selling Period: N/A

Age of Purchase: 18 years of age.

 

Maryland

Permitted: Sparklers containing no chlorates or perchlorates, ground based sparkling devices that are non-aerial non-explosive, and are labeled in accordance with the requirements of CPSC. Paper wrapped snappers containing less than 3/100 grains of explosive composition, and snakes that contain no mercury and are not regulated by DOT.

Prohibited: All fireworks not specifically permitted.

Selling Period:  Retailers must submit products for testing and approval to State Fire Marshal’s Office prior to sale.

Massachusetts

Permitted: N/A

Prohibited: Firecrackers, torpedoes, skyrockets, flares, candles, bombs, wheels, colored fire, fountains, mines, and serpents.

Michigan

Permitted: Consumer Fireworks as defined in APA Standard 87-1 sections 3.1.2, 3.1.3, or 3.5

Prohibited: All fireworks not specifically permitted.

Selling Period: N/A

Minnesota

Permitted: Wire or wood sparklers, ground-based sparkling devices which are non-explosive and non aerial, and contain 75 grams or less of chemical mixture per tube or a total of 500 grams or less for multiple tube items and include: fountains, cones, illuminating torches, wheels, ground spinners, flitter sparklers, flash / strobes, and novelty devices including snakes, glow worms, trick noisemakers, party poppers, and snappers.

Prohibited: All aerial fireworks and explosives such as firecrackers.

Selling Period: Year round.

Age of Purchase: 18 years of age.

 

Mississippi

Permitted: All consumer fireworks as defined by the DOT.

Prohibited: Cherry bombs, tubular salutes, repeating bombs, aerial bombs, and torpedoes.

Selling Period: June 15-July 5 and December 5-January 2.

Age of Purchase: 12 years of age.

 

Missouri

Permitted: Consumer Fireworks in compliance with the regulations of the CPSC.

Prohibited: Ground salutes that exceed DOT limits.

Selling Period: June 20-July 10 and December 20-January 2.

Age of Purchase: 14 years of age unless accompanied by an adult.

 

Montana

Permitted: Items meeting the CPSC requirements, except for items specifically prohibited.

Prohibited: Skyrockets, roman candles, bottle rockets.

Selling Period: June 24-July 5 and December 29-December 31.

Age of Purchase: 18 years of age.

 

Nebraska

Permitted: Novelty items, snakes, and sparklers do not require a permit to be sold in Nebraska. Gold and silver sparklers (colored sparklers prohibited) spray fountains, torches, color fire cones, star and comet type aerial shells without explosive charge, and lady fingers with a total pyrotechnic composition not to exceed 50 mg. each, color wheels and any other item approved by Fire Marshal.

Prohibited: All fireworks not specifically permitted.

Selling Period: Samples for all fireworks must be submitted to Fire Marshal prior to sale for separate test shoot examination.

Age of Purchase: 18 years of age.

 

Nevada

Permitted: Fireworks designated as consumer fireworks.

Prohibited: Dangerous fireworks, including large firecrackers, aerial displays and items that explode on impact or by friction.

Selling Period: N/A

Age of Purchase: 18 years of age.

 

New Hampshire

Permitted: Cone and cylindrical fountain, ground spinner, party popper, snake/glow worm snapper, wheel. (Small sparklers not regulated as Consumer Fireworks and therefore allowed.) Items listed on permissible fireworks list.

Prohibited: Items not specifically permitted.

Selling Period: N/A

Age of Purchase: 18 years of age.

 

New Jersey

Permitted: None.

Prohibited: Torpedoes, firecrackers, fireworks containing yellow or white phosphorus or mercury, fireworks containing an ammonium salt, and a chlorate.

New Mexico

Permitted: All consumer fireworks.

Prohibited:  Fireworks restrictions may be imposed during extreme drought conditions.

New York

Permitted: None.

Prohibited: Firecrackers, torpedoes, skyrockets, roman candles, and bombs.

North Carolina

Permitted: Sparklers, fountains, smoke devices, snake and glow worms, trick noisemakers, and toy pistol caps.

Prohibited: Explosive or aerial fireworks, roman candles, and rockets or similar devices.

Age of Purchase: 16 years of age.

 

North Dakota

Permitted: Star lights, helicopter flyers, cylindrical fountains, cone fountains, wheels, torches, colored fire, sparklers, dipped sticks, comets, shells, soft shell firecrackers not to exceed 1½” in length and ¼” in diameter, total pyrotechnic composition not to exceed 50 mg each.

Prohibited: Fireworks not specifically permitted.

Ohio

Permitted: Sparklers, trick noisemakers & novelties are exempt under Ohio law. Other consumer fireworks may be sold to Ohio residents upon execution of a form agreeing to take the items out to the state within 48 hours, or to out-of state residents upon execution of a form agreeing to take the items out the state within 72 hours.

Prohibited: All fireworks not specifically permitted.

Oklahoma

Permitted: All fireworks meeting the requirements of the CPSC, unless specifically prohibited.

Prohibited: Skyrockets, including bottle rockets or stick rockets, and M-80s.

Selling Period: June 15-July 6 and December 15-January 2.

Age of Purchase: 12 years, unless accompanied by adult.

 

Oregon

Permitted: Permit required. Those which produce only smoke, sparks or fire and which do not explode, eject balls of fire, fly into the air, or travel more than 6’ horizontally and/or 12” vertically from the point of ignition.

Prohibited: All other fireworks not specifically permitted.

Selling Period: June 23-July 6.

Age of Purchase: 16 years of age.

 

Pennsylvania

Permitted: Sparklers, toy pistols, or other devices in which paper caps are used which contain .25 grains or less of explosive compound, and are constructed so the hand cannot come into contact with the cap when in place for the explosion. Also permitted are toy cannons which operate on the principle of mixing calcium carbide, weighting less that 1/10th ounce and water in the reservoir of the cannon, and in which ignition results upon the creation of a spark.

Prohibited: Any combustible or explosive composition prepared for the purpose of producing a visible or an audible effect by combustion, explosion, deflagration or detonation. This includes, but is not limited to, firecrackers, skyrockets, roman candles, aerial fireworks, or other fireworks of like construction, and any fireworks containing any explosive or flammable compound.

Rhode Island

Permitted: Hand-held and ground based sparkling devices including fountains, illuminating torches, wheels, ground spinners, flitter sparklers, sparklers & novelties devices.

Prohibited: Aerial Consumer, Display Fireworks, and Pyrotechnics unless permits are obtained.

Selling Period: N/A

Age of Purchase: 18 years of age.

 

South Carolina

Permitted: Items meeting requirements of the CPSC.

Prohibited: Small rockets less than ½” in diameter and 3” long.

Selling Period: N/A

Age of Purchase: 14 years of age unless accompanied by parent.

 

South Dakota

Permitted: All fireworks that comply with CPSC regulations.

Prohibited: All consumer fireworks made wholly or in part of dynamite, nitroglycerin, or giant powder.

Selling Period: June 27-July 5.

Age of Purchase: 18 years of age.

 

Tennessee

Permitted: Items meeting CPSC requirements.

Prohibited: Illegal ground salutes and mail order purchase of fireworks by consumers.

Selling Period: Year round.

Texas

Permitted: All fireworks meeting requirements of CPSC and DOT Consumer Fireworks definitions, except for small rockets.

Prohibited: Small rockets.

Selling Period: June 24-July 4 and December 20-January 1.

Age of Purchase: 12 years of age.

 

Utah

Permitted: Cylindrical and cone fountains (effects no higher than 15’,) wheels with no more than 6 drivers, ground spinners, flitter sparklers, smoke devices, wire sparklers under 12” in length, party poppers, trick noisemakers, ground chasers that do not travel more than 10 feet laterally, snakes, and glow worms.

Prohibited: Firecrackers, cannon crackers, salutes, cherry bombs, sky rockets, roman candles, aerial fireworks that have effects higher than 15’, and chasers, whistlers, or other devices that travel more than 10’ laterally on a smooth surface or exceed 15’ in height when discharged.

Selling Period: June 20-July 25, December 20-January 2, and 15 days before and on the Chinese New Year.

Age of Purchase: 18 years of age.

 

Vermont

Permitted: Sparklers and novelty sparkling items limited to snakes, party poppers, glow worms, smoke devices, string poppers, snappers that are in compliance with CPSC regulations.

Prohibited: Firecrackers, skyrockets, roman candles, torpedoes, and daygo bombs.

Virginia

Permitted: Sparklers, fountains, pharaoh’s serpents, pinwheels, and whirligigs.

Prohibited: Firecrackers, skyrockets, torpedoes, and other fireworks which explode, travel laterally, rise into the air, or fire projectiles into the air.

Age of Purchase: 18 years of age.

 

Washington

Permitted: Consumer fireworks not specifically prohibited.

Prohibited: Firecrackers, skyrockets, salutes, chasers, and bottle rockets.

Selling Period: Noon, June 28-July 6 and December 31 6pm-12am.

Age of Purchase: 18 years of age.

 

West Virginia

Permitted: Sparkling devices (fountains, wire sparklers, trick noisemakers, smoke devices, snakes).

Prohibited: Firecrackers, torpedoes, sky rockets, roman candles, daygo bombs.

Selling Period: Year round.

Age of Purchase: 16 years of age.

 

Wisconsin

Permitted: Cylinder fountains, cone fountains, sparklers containing no magnesium, chlorate or perchlorate; snakes containing no mercury, small smoke devices.

Prohibited: Firecrackers, wheels, torpedoes, skyrockets, roman candles, aerial salutes, and bombs.
